Federal Court appeal in relation to the subclass 820/801 partner visa initially lodged in 2014 by the client’s former agent. It was refused and affirmed by an Administrative Appeals Tribunal (‘AAT’). The client, representing herself, appealed to the Federal Circuit Court. Unfortunately, the Court found no judicial errors in either the Department’s decision or in the AAT’s decision.

Our team took on the case at the Federal Court appeal stage. We successfully challenged the AAT decision regarding the shared residence of the sponsor and the applicant, which the Tribunal had failed to consider. Subsequently, we also secured a positive decision at AAT by providing comprehensive evidence and a persuasive submission. After nine years of waiting and legal battle, the client was finally granted permanent residence sc801 visa.
